Casa Banderas is a family-friendly residential urbanisation, consisting of 200 apartments and a big communal area. You are welcome to use the communal area during your stay. There are three outdoor swimming pool, a social area, gym and spa, padel court and a children’s playground. To keep the communal area nice for everyone we expect that you leave the area nice and clean after using it. Below you can read the rules of the Urbanisation Casa Banderas.
The community does not provide a lifeguard and all use of the pools is at your own risk.
The health, safety and use of community pools is governed by the Junta de Andalucia (decree 23/1999). The following shall be observed:
- The use of the pools is permitted between 10:00 to 22:00. Use of the pool will be permitted from 7:00 for those over 16 years of age, or if younger accompanied by an adult, as long as noise is kept to a minimum and swimmers must leave the pool if it is being cleaned.
- In the interests of hygiene showering before each swim is compulsory.
- An adult must accompany young children.
- Sun beds cannot be reserved nor should towels be left on a sun bed when not in use. Any towels or other items left unattended for more than 30 minutes may be removed.
- Ball games and activities that may annoy other users may not be played in the pool or surrounding area.
- Items of glass should never be taken into the pool or surrounding areas.
- Smoking is forbidden within the fenced areas around the pools.
- Owners must park their cars only in their own designated parking space. It is not permitted to park in such a way as to create problems of access to other residents, delivery vehicles or emergency services.
- Visitor car parking spaces are provided at the entrance it is not permitted for them to park in any other space unless express permission has been given by the owner of the space.
- Vacuuming of cars and inside cleaning of car windows are allowed.
- You are not allowed to wash or perform mechanical interventions on vehicles within the community. Repairing a vehicle that has broken down and cannot move is allowed.
- The electricity used to charge electric vehicles should be paid by the person charging that vehicle.
- The maximum speed within Casa Banderas is 20 km/h.
Pets are not allowed in the apartment.
- The social club is open from 8:00 to 21:00; for groups of 6 or more people, you must register at the concierge.
- Access from 21:00 onwards will require a reservation at the concierge.
- People must always respect the valid Covid rules set out by the government, local authorities as well as the administration of CB.
- Noise must be kept to a reasonable level and must not disturb neighbours. Music is not allowed after midnight (0.00) and general noise should be kept to a minimum.
- Any food left in the fridge will be cleared and disposed of after 24 hours.
- Use of the BBQ’s must be booked at the concierge.
- After use the BBQ and the social club area must be cleaned immediately and all rubbish taken to the external dustbins to be disposed of.
- The gym, spa and sauna are open from 8:00 to 22:00.
- The door to the spa and sauna will be kept locked. The key must be collected from the Concierge and returned after use. The door to the spa must be kept closed when the spa and Sauna are used.
- The spa and sauna must be booked at the concierge for up to a maximum of 2 hours. At the time of booking a deposit of 50 € must be paid, which will be returned once the concierge has confirmed that no damage has occurred.
- Children under 16 must not use the gym or spa without being supervised by adults.
- It is compulsory to shower before using the spa and sauna.
- The spa is a place for relaxation; do not use it as a conventional swimming pool.
- If there is water on the floor, it must be swiped to the drain.
- Leave the spa in the same condition as you found it.
- It is forbidden to consume food or beverages on the premises.
The paddle court is available from 8:00 to 22:00 and must be reserved through the concierge for a maximum of 2 hours.
- The children’s play area is restricted to the use by children under the age of 12.
- Children must be supervised at all times.
- Smoking is not allowed in the play area.
- All household/domestic rubbish must be disposed of in the correct bins near the main gates and not left next to it. If the bins are full, you should look for the closest bins that are not full.
- The small bins in the communal areas are for small items only not for general household rubbish.
- Rubbish must not be left in any communal areas, except for the small rubbish bins. If a rubbish bin is full, kindly take your rubbish home and inform the concierge of the rubbish bin that is full. Failure to comply with this rule will result in a written warning. If the failure occurs again a fine of 150 € to be paid to the community. The President has the authority to issue fines.
- The gardens linked to ground floor apartments belong to the community and the gardeners must be able to access them.
- Owners must not remove or harm the hedges or other communal plants
Owners are to be held full liable for any damage that they cause to community property.
This also extends to any damage caused to the community property by a resident, tenant or short term/holiday renter or non-paying guests. Full restitution for damages will be claimed from the person(s) responsible for them. However in the event that the Community is unable to make a successful claim it from the person(s) who caused the damage etc. Spanish law has already established that the responsibility to make restitution or repairs will be joint and several with the owner of the rented apartment. This is because the third party (resident, tenant or short term/holiday renter, or non-paying guests) will have used the facilities expressly with the apartment owner’s permission. The community will claim the damage from the owner. Supreme Court ruling: “If the tenant causes damage to common areas and does not repair them, the landlord is ultimately liable. In this case, he would be obliged to repair the damage caused”. As stated by the Supreme Court in the STS 832/239, of 18 December 2009
The responsible person(s) shall be notified by email of the nature of the damage, the cost of any repair or replacement and the method of payment.
For the purpose of this clause, people using or renting an apartment for a short term or for vacation are considered ‘vacation rental’(less than 3 months rental period) . All other use or rent is considered ‘long term rental’( more than 3 months rental period) . Vacation rental and long term rental are collectively referred to as ‘rental’.
- All apartments subject to vacation rental shall have a valid Tourist Rental Licence as required by law in Spain, and a copy of the Tourist Rental Licence shall be sent to the concierge.
- Rental agencies operating in Casa Banderas must give the concierge a contact name, email and telephone number.
- All vacation renters must check-in with the concierge upon arrival. They shall present the rental agreement and/or evidence of rental approval by the Owner. Any long-term rental shall be introduced to the concierge via email by the relevant owner and the long term renter shall be requested to introduce himself or herself with the concierge.
- It is the responsibility of the owner to ensure that renters/borrowers are given a copy of the house rules and they are told which parking space they can use.
- It is the legal responsibility of the owner of an apartment to have all contact details and personal information of the renters/borrowers and to provide such information to the community in the event that they break any rules/laws or cause any damage to property of the community.
- Vacation renters are only allowed to bring guests into the rented apartment as the owner and rental regulations allow. Vacation renters are not allowed to bring guest into the common facilities as social club, swimming pools, gym and spa, paddle court as well as children’s play area.
Casa Banderas is not a holiday resort but a residential urbanisation, however vacation rental is allowed.
